Terms of Service

1. Scope

These Terms of Service govern your use of the Embrace Pregnancy mobile application (the “App”) and its associated website at https://embrace-pregnancy.app. The provider is:

The App is provided free of charge. By installing and using the App you agree to these Terms. If you do not accept these Terms, please do not use the App.

2. Eligibility

The App is intended for adults (18 years and older). Minors may only use the App with the consent of a parent or legal guardian. The App is intended solely for personal, non-commercial use.

3. Acceptable Use

You agree not to misuse the App. In particular, you must not:

  • use the App for unlawful purposes;
  • circumvent security mechanisms or probe, publish, or exploit vulnerabilities;
  • use automated scripts, bots, or scrapers;
  • prompt the AI companion Verena in ways designed to harm others or encourage dangerous actions.

4. Important Notice on the AI Companion Verena (AI Act Art. 50 Transparency)

Verena is an AI-based companion, not a medical professional. Verena’s responses are automatically generated by a large language model. Verena:

  • does not provide medical advice,
  • does not diagnose any condition,
  • does not prescribe treatment, medication, or therapy,
  • does not replace the advice of a doctor, midwife, or any other qualified healthcare professional.

The information in the App is provided for general information and support only. For any medical question, symptom, or emergency, please contact your doctor, your midwife, or emergency services (112 within the EU) without delay.

You acknowledge that generative AI systems can make mistakes, provide incomplete or factually incorrect answers (“hallucinations”), and are not tailored to your individual medical situation.

5. Warranty and Liability

The App is provided “as is” and free of charge. To the maximum extent permitted by applicable EU consumer law, we disclaim all implied or express warranties beyond those required by law.

Embrace Life Technologies is not liable for:

  • damages arising from following information provided by the App or by Verena;
  • indirect damages, loss of profit, or immaterial damages;
  • outages, data loss, or App impairments, except where caused by intent or gross negligence.

Statutory liability for intent, gross negligence, personal injury, and product liability remains unaffected. Mandatory rights under EU consumer law (in particular Directive (EU) 2019/770 on digital content and services) also remain unaffected.

6. Intellectual Property

All content in the App (text, graphics, code, logo) is protected by copyright and belongs to Embrace Life Technologies S.p.A. Società Benefit or its licensors. You are granted a simple, non-transferable, non-sublicensable right to use the App for personal purposes.

7. Privacy

Processing of personal data is described in the separate Privacy Policy.

8. Changes to These Terms

We may occasionally update these Terms, for example due to changes in applicable law or App functionality. The current version is always available at https://embrace-pregnancy.app/en/terms-of-service/. We will notify you of material changes in the App.

9. Governing Law and Jurisdiction

These Terms are governed by Italian law, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Bolzano, Italy. For consumers, mandatory consumer protection provisions of their country of residence apply. EU consumers can also use the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/.
